What is a grant of representation?

This is the court order authorising the personal representatives to deal with the administration of the estate.  If the deceased left a will, this is known as a grant of probate and where the deceased did not make a will the grant is known as a grant of letters of administration.

How long will it take?

This will depend on a number of factors, to include whether inheritance tax is payable, whether there are foreign assets or property to be sold.  The majority of estates can be administered within 6 – 12 months.

What are the duties of the executor

If the deceased left a will, the personal representative is called the executor.  If the deceased did not leave a will (died intestate), the personal representative is called the administrator.  In either case the personal representatives are responsible for collecting the assets of the deceased, paying any liabilities and distributing the estate to the correct beneficiaries.
